Terms of Service

These Terms of Service (“Terms”) govern your use of the TopoLink iOS application (“TopoLink” or the “App”) and the website at https://www.nexvorat.com/ (the “Site”), provided by Nexvorat Technologies LLC (“Nexvorat”, “we”, “us”, or “our”).

By downloading, accessing, or using TopoLink or the Site, you agree to these Terms. If you do not agree, do not use the App or the Site.

1. The service

TopoLink is an iOS VPN client.

It uses Apple’s Network Extension (Packet Tunnel) to help you connect using VPN configurations associated with your network service provider.

You understand that:

  • TopoLink provides client software functionality;
  • accounts, servers, traffic packages, pricing, and service availability are determined by your provider;
  • you are responsible for ensuring you have the right to use any verification code, credentials, and configurations you enter;
  • Nexvorat does not sell VPN subscriptions or server capacity through TopoLink unless explicitly stated otherwise in a separate offering.

2. Eligibility

You must be able to form a binding contract under applicable law and must comply with all applicable laws when using TopoLink.

3. Accounts, verification codes, and credentials

Depending on your provider, you may need a verification code, login credentials, tokens, or subscription details.

  • You are responsible for the accuracy of information you enter.
  • You must keep credentials confidential and secure your device.
  • You must not use another person’s credentials without authorization.
  • Provider billing and account status are handled by your provider.

4. Acceptable use

You agree not to:

  • use TopoLink for unlawful purposes;
  • conduct network attacks, unauthorized scanning, phishing, or malware distribution;
  • attempt to reverse engineer, decompile, or interfere with the App, Site, VPN components, or related systems except as permitted by law;
  • misrepresent your identity or affiliation;
  • violate export control, sanctions, or local networking regulations applicable to you.

5. Third-party services and application gateway

TopoLink may communicate with:

  • Nexvorat’s application gateway for workspace verification, authentication proxying, and configuration sync; and
  • your provider’s endpoints and Apple platforms/services.

Third-party terms and privacy policies apply to third-party services. We do not control and are not responsible for third-party outages, billing, content policies, or server performance.

6. Intellectual property

The App, Site, branding, and related materials are owned by Nexvorat or its licensors.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use TopoLink for personal, lawful purposes on Apple devices you own or control, as permitted by the App Store Terms.

You may not copy, modify, distribute, sell, or lease any part of our software or branding except as allowed by law or written permission.

7. App Store terms

If you download TopoLink from the Apple App Store, Apple’s App Store terms also apply. Apple is not responsible for providing maintenance or support for the App beyond what Apple’s terms require.

9. Disclaimers

THE APP AND SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • the App will be uninterrupted, secure, or error-free;
  • provider configurations or servers will always work;
  • any particular speed, route, availability, or jurisdiction access will be achieved.

VPN connectivity depends on your device, network conditions, Apple platform behavior, and your provider’s infrastructure.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXVORAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR SITE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR SITE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO NEXVORAT FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD $50.

Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the fullest extent permitted.

11. Indemnity

You agree to defend, indemnify, and hold harmless Nexvorat from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or third-party rights.

12. Termination

You may stop using TopoLink at any time by deleting the App.

We may suspend or terminate access if you violate these Terms or if we discontinue the App.

Provisions that by nature should survive will survive termination.

13. Changes

We may update these Terms by posting a revised version on this page and updating the “Last updated” date. Continued use after changes means you accept the revised Terms.

14. Governing law

These Terms are governed by the laws applicable to Nexvorat Technologies LLC’s principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply.
